1. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using Sixart you represent that you meet this requirement and that the information you provide is accurate and current.

You are responsible for safeguarding your account credentials and API keys, and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

2. Use of the Service

Sixart lets you generate, edit, and compose images, video, and audio using AI models. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service.

You agree not to:

• Use the Service to create unlawful, infringing, harmful, or deceptive content.
• Generate content depicting real individuals without consent, child sexual abuse material, or non-consensual intimate imagery.
• Reverse engineer, resell, or abuse the Service, its models, or its API beyond your plan’s limits.
• Attempt to bypass usage, rate, or credit limits, or to access the Service through unauthorized means.

3. Credits, Plans & Payments

Generations consume credits according to the pricing shown in the app at the time of use. Paid plans and credit packs are billed through our payment processor. Subscriptions renew automatically until cancelled.

Prices, credit costs, and plan features may change; we will make reasonable efforts to notify you of material changes in advance.

4. Your Content & Ownership

You retain ownership of the prompts and inputs you provide. Subject to your compliance with these Terms and applicable law, you own the outputs you generate, to the extent such outputs are eligible for ownership.

You grant X38 AI Labs a limited license to host, process, and display your content as necessary to operate, secure, and improve the Service.

You are solely responsible for the content you generate and how you use it, including ensuring you have the rights to any inputs you upload.

5. Intellectual Property

The Service, including its software, branding, and design, is owned by X38 AI Labs and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or technology except as expressly stated.

6. Disclaimers

AI outputs may be inaccurate, offensive, or unexpected. The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by law, X38 AI Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our aggregate liability is limited to the amounts you paid us in the twelve months preceding the claim.

8. Suspension & Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties. You may stop using the Service at any time.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
